These Client Member Terms of Access ("Access Terms") apply to you if an InfluenceKit customer has invited you to view specific campaigns in their InfluenceKit workspace. For your use of that workspace, they replace our general Terms of Use.
In these Access Terms:
These Access Terms are the entire agreement between you and us about your access to the workspace. They apply instead of our Terms of Use and Terms of Sale, which do not apply to you as a Client Member. Nothing in those documents, including their indemnity, creates any obligation for you. Our Privacy Policy applies to your own account information.
You accept these Access Terms as an individual user of the workspace. They are not a contract between InfluenceKit and your employer, and nothing here commits your employer to anything.
Within your Permitted Campaigns you can:
The Customer may additionally grant you access to Influencer Discovery, to Signals and competitive intelligence, or to the Report Builder. If you are granted the Report Builder, you can create, edit and delete reports that you create yourself.
You cannot:
You will never be charged anything by InfluenceKit for this access. The Customer pays for the subscription.
You will treat the contents of the workspace as confidential, use it only to review your Permitted Campaigns, and not disclose it outside your organisation except to people who need it for that purpose. This includes creator personal information, creator rates, and the Customer's other commercial information.
We will treat information you enter as confidential on the same basis, and will not disclose it except as needed to provide the service or as required by law.
The Customer controls the workspace and its contents. We hold and process that content for the Customer under our agreement with the Customer. If you want content corrected, exported or removed, ask the Customer. We will act on the Customer's instruction rather than yours, except where the law gives you a direct right.
Your own account information is handled under our Privacy Policy.
You keep ownership of comments you post. You give us permission to store and display them inside the workspace so the Customer and other permitted users can see them. You are responsible for not posting anything you do not have the right to post.
Do not try to reach parts of the workspace you have not been granted, do not attempt to defeat the access controls, do not scrape or bulk-extract the workspace, and do not share your login. Tell us promptly at help@influencekit.com if you think someone else has used your login.
You may share a report's public link with people inside your organisation who need it. Treat those links as sensitive: anyone holding the link can open the report without logging in.
The InfluenceKit platform, and everything in it other than Customer content and your own content, remains ours. These Access Terms permit you to use it for the purpose described above and for nothing more.
We will provide the workspace with reasonable care and skill. We do not promise it will be uninterrupted or error-free, and we do not promise that data drawn from Instagram, TikTok, YouTube or other third-party platforms is complete or accurate, because we depend on what those platforms return to us.
Neither party is liable to the other for indirect, incidental, special or consequential damages, or for lost profits, revenue or goodwill, arising out of these Access Terms.
Neither party's total liability to the other under these Access Terms will exceed US $100.
Either party may ask a court to stop a breach of clause 4 or clause 7, and nothing in this clause limits that.
These limits do not apply to fraud or willful misconduct, or to any liability that cannot be excluded or limited under applicable law.
Your access continues until the Customer removes it, the Customer's subscription ends, or we end it under these Access Terms. The Customer can remove your access at any time. We can suspend your access if we reasonably believe it is being used in breach of clause 7.
Confidentiality, Whose data this is, Your comments, Our intellectual property, Limitation of liability and Governing law survive the end of your access.
We may change these Access Terms. The version number and the date of the last change are shown at the top of this page. If we change them in a way that materially affects you, we will tell you, and continuing to use the workspace after that means you accept the new version.
These Access Terms are governed by the laws of the State of Minnesota. Any lawsuit relating to them must be brought in the state or federal courts of Minnesota.
